Terms of Service

Rescue AI provides software that helps businesses respond to missed phone calls, communicate with their customers via text message, and book appointments automatically. Features may change, improve, or be discontinued over time. We will not materially reduce the core functionality of your plan during a paid billing period.

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

• The Service is billed as a recurring monthly subscription at the rate shown at checkout.
• Payments are processed by our third-party payment processor. By subscribing, you authorize recurring charges to your payment method.
• You may cancel at any time; cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial months unless required by law.
• We may change pricing with at least 30 days' notice; changes apply from your next billing cycle.
• Accounts with failed payments may be suspended until payment is resolved.

You agree to:

• Use the Service only for lawful business purposes
• Obtain any consents required by law before messaging your customers, and honor opt-out requests (for example, STOP replies)
• Comply with applicable telecommunications and messaging laws and regulations, including (where applicable) the TCPA, CAN-SPAM, and carrier messaging policies
• Not use the Service to send spam, unsolicited bulk messages, or content that is unlawful, deceptive, harassing, or harmful
• Not resell, reverse engineer, or interfere with the Service or its security

We may suspend or terminate accounts that violate this section, with or without notice, to protect the Service, carriers, and other customers.

SMS delivery depends on third-party telecommunications carriers and is not guaranteed. Carrier filtering, registration requirements, network outages, and other factors outside our control can delay or block messages. Message and data rates may apply. You are responsible for the content of messages sent through your account and for your compliance with messaging consent requirements for your customers, including honoring opt-out requests such as STOP replies.

We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

You retain ownership of the data you and your customers submit through the Service ("Client Data"). You grant us a limited license to host, process, and transmit Client Data solely to provide and improve the Service. We handle personal information as described in our Privacy Policy.

The Service, including its software, design, and branding, is owned by Rescue AI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or software except the limited right to use the Service during your subscription.

The Service relies on third-party providers (such as telecommunications carriers, hosting, and payment processors). We are not responsible for the acts, omissions, or availability of third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY MESSAGE WILL BE DELIVERED, OR THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR BUSINESS OUTCOME, REVENUE, OR NUMBER OF RECOVERED CALLS OR BOOKINGS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESCUE AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You will indemnify and hold harmless Rescue AI from claims, damages, and expenses (including reasonable legal fees) arising from your Client Data, your use of the Service in violation of these Terms, or your violation of applicable law, including messaging consent laws.

You may stop using the Service and cancel at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, or where required to protect the Service or comply with law. Upon termination, your right to use the Service ends; sections that by their nature should survive (including Sections 6–11) survive termination.

We may update these Terms from time to time. The "Last updated" date reflects the latest version. Material changes will be posted on this page, and continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the jurisdiction in which Rescue AI is organized, without regard to conflict-of-law rules. Any disputes will be resolved in the courts of that jurisdiction, unless applicable law provides otherwise.
